Here is the order from The Honorable Terrance Thomas.
Here are a few of my comments about this order and the reason's I believe it was a just order.
Since our daughter signed her rights away on May 10, 2006 Barb and I were the only ones considering adopting our granddaughters. We were never contacted as well none of these young ladies other family members were ever contacted.
During a post termination hearing on August 9, 2006 Lace Gonzales-Borstler made this comment:
"They are in foster care with the same foster mother throughout this whole ordeal. She does not feel it's in their best interest for her to be the adoptive parent. She believes that those children need a two-parent family. I wish she would reconsider, but that's not going to happen."
That statement was not true because these children were not with Nicole during this whole ordeal. The children were returned to their mother in December 2005 then returned back to Nicole. Nicole doesn't want to adopt.
During a post termination hearing on November 8, 2006 Lace Gonzales-Borstler made this comment:
"Yes, in the event--at this point the grandparents and another relative have expressed interest in adoption and the assessments on those homes are in the process of being completed. And in the event that those homes are not found suitable there will be--there is a possible placement that could potentially be looked into"
Again I don't believe Lacy was being completely honest with the court this day. Bethany had already finished our adoption assessment on October 26, 2006. You can't tell me Lacy didn't already know the results of our assessment before this hearing. The other family was on the central registry. Lacy knew they would not be approved.
Basically as the judge states the only progress that had been made was us being denied and the foster being pressured into adopting. This was the reason he revoked the MCI commitment to these children, no permanency.
